Well, Erik Chevalier's misappropriation of the kickstarter money approaches, and probably is, actual criminal fraud.

I see no way that you could argue that it isn't. Chevalier accepted the money, then promised to either produce and distribute the backer rewards, or to give a full refund. He did neither of those things and instead spent all the money on himself.
